Iraq draft says laws must conform to Islam -text BAGHDAD, Aug 22 (Reuters) - A draft constitution for Iraq to be presented to parliament on Monday will make Islam "a main source" for legislation and ban laws that contradict religious teachings, members of the parliamentary drafting panel said.

I will admit that if the Iraqy consitution reverts to a theocracy then I will say the war was a failure.

I'm still a Bush supporter...After watching how Clinton and his policies allowed OBL and Al Q to grow...I'll take the over agressive position to protect US anyday.
Bush wouldn't worry about a swing set in a terroist camp.

That national geographic thing last nite was outstanding.Part II is on tonight.

Update (10:45 pm local time):

Chairman of the National Assembly Hachim Al-Hasani announced that discussions are still underway among all involved parties in hope for reaching "accord" before disclosing the draft; this is expected to be done within an hour and then the Assembly shall start a session to approve the draft immediately after that. This is of course in effort to convince the Sunnis to be part of the process, however if this last discussion fails the Sheat and Kurdish blocks are most likely to present the draft without the "OK" from the Sunni politicians.

Meanwhile there have been rallies of joy and celebrations in many Iraqi cities mainly in the south and people went to the streets in thousands although it's past 10 pm now. The Iraqi TV has been playing patriotic songs all the evening and in between the incoming reports and updates; one song named "Good bye sadness" was played more than 20 times so far!!

"Regarding Islam and the constitution: it was agreed upon that no laws that are against the widely agreed upon values of Islam can be issued and no laws that are against the values of democracy and human rights can be issued....."

Lets wait for the final copy...I never expected Jeffersonian democracy.

We'll have to wait for the final draft I guess....they are voting now.

Good chance this "constitution" turns out to be little more than a Koran sandwich....

Shiites and Kurds were sending a draft constitution to parliament on Monday that would fundamentally change Iraq, transforming the country into a loose federation, with a weak central administration governed by Islamic law, negotiators said. The draft, slated for action by a Monday deadline, would be a sweeping rejection of the demands of Iraq's disaffected Sunni minority, which has called the proposed federal system the start of the breakup of Iraq. Shiites and Kurds indicated they were in no mood to compromise. "We gave a choice -- whoever doesn't want federalism can opt not to practice it," said Shiite constitutional committee member Ali Debagh. Debagh acknowledged the Sunni minority would be unlikely to accept such a draft in a national vote scheduled for October, saying, "We depended upon democracy in writing the constitution and will depend upon it in the referendum."



. . . Washington has been pushing hard to stick to a timeline on government-building that would allow for a significant troop withdrawal as soon as early next spring.

And what of this constitution? The "noble cause":

Federalism:



Key provisions of the draft would formalize an already autonomous Kurdish state in the north, under a federal system. The rest of the country also would be allowed to form federal systems -- opening the way for the demand by the dominant Shiite Supreme Council for Islamic Revolution in Iraq to create a southern Shiite sub-state out of up to half of Iraq's 18 regions. Sunnis and others say such a state would be under heavy influence from neighboring, Shiite-ruled Iran.​

How very noble.



The draft also stipulates that Iraq is an Islamic state and that no law can contradict the principles of Islam, Shiite and Kurdish negotiators said. Opponents have charged that last provision would subject Iraqis to religious edicts by individual clerics.​

Wonderfully noble.



The Shiite and Kurdish negotiators also said draft calls for the presence of Islamic clerics on the court that would interpret the constitution. Family matters such as divorce, marriage or inheritance would be decided either by religious law or civil law as an individual chooses -- a condition that opponents say would likely lead to women being forced into unfavorable rulings for them by opponents demanding judgments under Islamic law.​
