I was just curious... Does anyone know if Bush actually declared war? If so, is it true that this would be the first war that the USA declared since WWII?

So, I know he needs to get Congess' approval after a certain number of days... Is there any limit to how long they can kill people and attack a sovereign nation without delaring war? Isn't that the correct thing for him to do?

There was no declaration of war. Therefore this war is illegal and unconstitutional. This is another example of the executive branch usurping powers granted to the legislative branch by the constitution.

And a resolution to authorize the president to attack Iraq is NOT a Declaration of War. The Constitution expressly stated that a DECLARATION OF WAR is the only form of authorization allowed.

Obviously there is a reason why they do not want to delare war. It certainly would add some sort of legitmacy. Does anyone here know why they do not want to declare war?

They call it war. The USA military has attacked a sovereign nation against the United Nations and most civilized nations of the world. Why will they not delclare war then. Does it make them obey certain rules etc? I am truly trying to get an answer...

Bush cannot declare war. Congress declares war. (Article 1 Section 7)
But this isn't even a war in the strictest sense, mainly due to the fact that the enemy is so much less equipped than the US.

And unless they changed the Consitution (minor adjustments post-9/11), armed intervention for 60 days, after which Congress declaration of war is needed, then assuming no declaration, Prez has 30 days following that to withdraw troops.

cussin it... got it... you seemed to have a poly sci background. So maybe you could best tell me why would they not want to declare war. This is the only time that I can remember that the USA blatantly invaded another country where the other country was not under attack (liberating Kuwait), in a civil war( Vietnam and Korea), etc. Since the USA stole California from Mexico... But I may be forgetting something...

Quite a few instances since War Powers Act adopted in 1973 (over the veto of one Richard Nixon).
RFC has listed several....Bosnia, Haiti, Somalia and numerous others.....the following is a bit technical and worded but would help you understand the issues more.
A lot of it has to do with funding, the allocations of resources for these actions, and the ability of Congress to provide budgetary measures to support or not to support military engagements..
