Would you want Bush to appoint a justice who will vote to overturn Roe v Wade, overturn affirmative action laws...overturn all the decisions you opposed? If so, why do you think an activist court is good? :digit:

No, I don't want an activist court. Although I do want a court to overturn activist decisions that have been made if the issuues come up before the court again, a few of which you have mentioned.

For those who believe abortion is murder they want a judge who will overturn the ruling that will help stop the genocide.

That's a bad definition of 'activist court' D2. To conservatives, an activist court is one that twists the Constitution around in order to fit its political agenda....legislating from the bench. Roe v Wade is just one example.

Activist is ignoring long-standing and well-developed precedent. Roe v Wade is 32 years old and has a litany of constitutional jurisprudence upholding and defining it, not the least of which is the undue burden standard that was crafted by O'Connor. Throwing all of that out the window is the defintion of judicial activism. It's one thing to take on new arguuments and draw distinctions from differing facts, but it's quite another to trash clear precedent. Once that starts, then there is no consistency in the law.

If every judge simply interpreted the Constitution, as they should, then at least half of all the laws out there would be tossed, including any restrictions on abortion.

Roe isn't going to be overturned.Jesus I never seen a bunch of baby killers so paranoid about a law in my life.Its the law of the land,unfortunatley for those with forceps and a scapel at the base of their brain.

You people should be paranoid about the possibility of you local goverment selling you and your house down the drain thanks to those fucking communist judges.

An activist court is one which "makes new law" instead of making judgements according to existing statutes. US courts have evolved into something they were never meant to be, lawmakers.

That was a bad decision too. One in which 3 of the 5 judges voting for it were nominated by Republicans.

Uh, let's see. Uhhhh, maybe it's the judges fault for failing in their responsibility to interpret private property rights outlined in the Constitution?

But certainly beyond the judges, next most responsible would have to be the presidents who appointed them, and then those in congress who confirmed them. Regardless, not a single one of the justices on that court deserve the job they have.
