Accident witness needed

Hi everybody,

My name is Mike and most of you know me already from the computers and satellite systems.

I got into an accident yesterday morning around 9.30am on the highway from Santa Ana to Escazu, just below the Land Rover place or Machu Pichu, the hill, with the slow moving traffic most times in the right line.

I drove up the hill in the left line in traffic with cars behind and in front of
me. The gap to the car in front of me was normal for cars going with 60-70km per hour. A small dump truck pulled out right in front of me and I rear ended the truck. There was no chance of stopping, he was just to slow, it happened to quick. Even that I slowed my car down to under 16 km per hour ( had to be like this because my Airbags didn't activate ) at the moment of impact, I still have severe damage to my vehicle.

There was a friendly Tico lady who stopped right when the accident happened, she offered her name and phone number as a witness against the truck driver.

The truck driver stopped about 30 meters ahead, got out, apologized, admitted his fault and told me not to worry since his truck is a company vehicle and they are all insured.

We called the cops and the INS because of the insurance. Both came and toke all our data and pictures. The driver admitted again his fault to both and even signed the INS report with a cross where he admits to be guilty.

Later on in the afternoon, I went to the Companies office to get an
authorization to present the Car to the INS. The Boss from the driver said that they wouldn't authorize anything, I rear ended the truck, it's all my fault, I'm the Gringo and the court will decide against me anyway and that I can go now and F… off.

There was a friendly Tico lady who stopped right when the accident happened, she offered her name and phone number as a witness against the truck driver.

My lawyer told me that the Boss of the guy is probably right, since all those guilt statements means NOTHING at traffic court. The only thing that counts is the drivers statement there!

I am writing this hoping to find more people who have seen what happened, I need more witnesses to testify in my behalf.

The damage to my truck with parts from CR is roughly USD 20000,- - no damage to the dump truck !

Maybe I get lucky and somebody who witnessed the accident.

I will post this in all other Groups, local classifieds and also in the "Extra"
and "La Nacion" on Thursday or Friday.

I am just sick and tired of getting screwed over by these people. They admitted to me and a friend to lie in Court to get around paying the deductible from the Insurance.:>(

Sorry for the bad news but you are screwed...you hit somebody from behind...

Happened to me in 2003...no matter the circumstances, you hit someone in the rear and you can't win....

It not that you are gringo. It's your fault. You hit him in the rear. It is the same as in the States.

since you sound like a straight up guy, , I will go, because I "saw" ;) the accident and Im willing to take a small fee to screw those fuckers..... glglglgl

That's not true... you can't just pull out in front of moving traffic when you don't have room in the states. :think2:

He did not hit the front of the truck/side, he hit the guy in the back. He is at fault, just like the states.:think2:

if you turn into oncoming traffic and get hit from behind, your still at fault for turning into traffic that had the right away

hit from behind guilty rule is not necessarily true. It used to be like that for years but recent rulings had made a precedent.

Get a couple of fake witness (you must play their game). You will not win the case but at least it will be ruled as no ones fault 50/50. This way you won't end up paying them!!!

Thanks guys,

Going up the hill there, I was doing about 60 km per hour which equals to about 15 meters per second, it takes the average guy 1 second to react and onother second before the car really starts to slow down. 30 meters are gone by in just those 2 seconds, this is about 6 to 7 car lenght. The guy pulls out, there is no way to stop behind him. These trucks go up the hill there sometimes slower that 15 km per hour, one pulls out, it's like a wall in fron of you !

It was a dump truck, no damage to his vehicle ! I have only so much damage because he had no bumper and I hit him high up, just below the bed right with the upper part from my radiator grill. Bumper to bumper would have been minor or no damage.
