I don't thinkthe U.S. Attorney's Office for the Southern District of New York is necessarily a thief.

hey ah, dude. Is there anything in my post that's accusing the USAO for SDNY of being the thief. A little tight there. I don't know all the details, but if Americans don't get there money back, there are thieves involved, whether it's Neteller or whoever. What if the USAO hits Neteller so hard financially that they can't pay all Americans back..

I am going to go out on a limb and guess that the DA does not get an indictment out of the grand jury.

The charge of money laundering is ludicris. Part of money laudering requires hiding illegal money as legal. Neteller had a public prospectus stating exactly what they do. There was no intent to hide.

The Feds could not get an indictment by Feb 14th and asked for a month's extension (Very rare). I doubt they get one by March 16th.

Probably another extension and then they'll seek some bullshit like promoting gambling and drop the money laundering charges...

just because they had a prospectus, doesn't mean their intent wasn't to hide the illegal nature of the business according to federal law.

I'm starting to agree there Sean1. But the damage has already been done temporarily to the gambling industry and especially Neteller customers. We should get our money. But better believe that Uncle Sam will know about it.

While I'm not exactly familiar with your legal system I believe there is no grand jury involved in this case.

The founders were arrested on the basis of a complaint and my understanding is that the DA proceeds to a direct indictment, without any need for a grand jury. So the decision is entirely up to the DA regarding whether the complaint warrants prosceution..

As the old saying going, you can indict a cheeseburger if you want to. The fact that they delayed the hearing for a month liely means that both sides wanted the chance to discuss a deal

I hate to be negative, but there is zero chance that there will be any deal soon, if at all. There is no way uncle sam is going give back any of the 55 mil they have. There is no hurry for either party. Both parties are making millions off our funds in interest alone. We are paying for the Neteller attorneys.

Have you ever heard of uncle cutting a deal with someone dealing drugs and part of the deal is they get their money back? Uncle is holding all the cards here and have nothing but time on their side.

The hearing date in March will do nothing to get funds back.

Its a federal case and just like the BOS case, a grand jury has to return an indictment. They can arrest on suspicion and then get the indictment. They did not withhold it to negotiate. They can indict and then negotiate. If they don't indict on March 16th, it would be really unusual.

Of reasonable note, I was in San Diego Monday. Stayed at a hotel with the CA das - they were having a meeting. I asked 3 about neteller and none had ever even heard of it.

Glen, what did they hide? Their prospectus talked about gambling merchants. Their website talked about gambling merchants. Barring tattooing it on the directors foreheads...

I agree that neteller is making interest from our money. But I highly doubt that uncle sam is making any interest out of that 55 mil.

They cant do that without Due Process its against the 12th Amendment, and there is no "Blanket" case. The Fed's would have to try each and every case in order to confinscate the $$ Permanently. That won't happen

As I said I'm not familiar with your legal system but both the issuance of a complaint against the NETeller founders and my reading suggests that a grand jury is not involved.

"In many (though not all) U.S. jurisdictions retaining the grand jury, prosecutors often have a choice between seeking an indictment from a grand jury, or filing a charging document directly with the court. Such a document is usually called an information, accusation, or complaint, to distinguish it from a grand jury indictment."

Well regardless of how the prosecutors plan to file the charges, they asked for a delay on Feb 14th. They have yet to formally file charges for some reason...
