American Express is suing the CEO of a communications company for payment of $241,000 worth of disputed credit card charges at a Manhattan topless club.

American Express says in papers filed in state court that Savvis Inc. chief executive officer Robert A. McCormick was in the club Scores in October 2003 with at least three other men.

After McCormick got the $241,000 corporate credit card bill, Savvis called American Express and complained that some of the charges were fraudulent, the lawsuit says. The communications company said its chief disputed all but about $20,000, according to the lawsuit.

"We firmly believe that Mr. McCormick was the victim of fraud," said Deena Williamson, Savvis's deputy general counsel. She declined to comment further.

Lonnie Hanover, a Scores spokesman, said he had not talked to all of the employees involved with McCormick and could not say what the CEO purchased.

The lawsuit filed Wednesday against McCormick and Savvis is at least the third in the past two years involving contested credit card charges at Scores. One patron sued the club after he got a $28,000 bill and another disputed $129,000 in charges.

After a lawsuit last year, Hanover said that "high rollers" visiting Scores' "super elite Presidents' Club" spend thousands of dollars on single bottles of champagne and tip strippers as much as $10,000 for lap dances and for spending time with them.

The district attorney's office has said it is investigating alleged overcharging at Scores.

Hanover said that each time a patron spends $10,000, Scores calls the customer's credit card company to get the charges approved. Scores even fingerprints the customer and requires him to get on the telephone with a credit card representative, he said.

"We got authorization for all of the charges," Hanover said of McCormick's visit. "We followed proper procedures and documentation, and we were paid."

Court papers say American Express asked McCormick several times to provide in writing his basis for calling the charges fraudulent. McCormick failed to respond, and when he was billed again he once again objected to the charges, the lawsuit says.

American Express says McCormick finally responded in writing in September 2004, reiterating that some charges on the Scores bill were bogus, the lawsuit says.

Scores has been paid in full, American Express's court papers say, while neither Savvis nor McCormick has paid any of the charges. Failure to pay is a violation of the American Express corporate credit card agreement, court papers say. An American Express spokeswoman, Judy Tenzer, said she had no comment

The CEO stands no chance in court. This lawsuit will get taken care of before going to trial.

Not so sure about that. I would agree if the CEO was trying to keep this quiet but this story has been public for over a year and no one has been in a rush to pay up. If he's got a legit beef and no concern for tarnishing their public image I could see this going the distance.

Under no cirsumstances is this guy paying $241k - if Amex paid the strip club they are out that money - I cannot believe Amex would pay out a 1/4 mil to a strip club - they deserve to lose the money if they are so dumb to not see this was going to be a problem - 241k at Scores? come on - maybe $2000 but no more.

I was surprised they paid such a large disputed amount too.

Inversely, $2,000 does not get you too far either if you're entertaining high rolling clients. Not sure if you've been there but it's not your local go-go bar.

In a past life I use to work at AMEX so I know how these things go down. AMEX isn't stupid there not letting more than a 100k charge go thru at a place like that without talking to the guy directly and asking him how much he is spending thru the night. I was still at the company when this went down. The guy is claiming that scores threaten him to sign each and every single one of CC slips. That is his excuse. This is one of the few times I hope AMEX puts the vice on the guy since I have no doubt him and his friends spent that much there since scores would have no reason to muscle the guy since they don't need too.

BTW if AMEX loses the case they take the money back from scores if did wanted too since its in there merchant contract so AMEX isn't dumb for letting 250k go thru. I've seen charges for 1million plus go thru from some companies/people since those groups have already built up a relationship with the company.

when will these CEO's learn, you can't charge strippers to your AMEX card, Eventually it all comes out!

I feel for the lost income to Costa Rica, for a 1/4 of that bill we could have "outsourced" all these services

Stories like this are why I became a short. Buy and hold is for SUCKERS!!!

That's $241,000 of what I consider "stolen" shareholder profits. And it is rare that "stolen" profits are ever frowned upon.

Everyone is on on the take EXCEPT for the indicidual investor. The Board members have salaries and options. The top managers all have ridiculous salaries and options. The fund managers who hold their stocks are in on the take too and if you think they aren't you are naive.

Since I started trading as a short term short, I am trouncing my results as a long term buy and hold (which trounced the DOW).

The ONLY thing that separates a stock, publicly traded stocks that you or I will never control, from a ponzi scheme, is the potential for a dividend (that most stocks will never pay).

Done with my little rant.
